Acceptance of Terms

By accessing or using the Artisan Kulture website at artisankulture.com, requesting a quote, entering into a project agreement, or otherwise engaging our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.

These Terms apply to all visitors, clients, vendors, and any other parties who interact with Artisan Kulture. If you do not agree to these Terms, please discontinue use of this website and our services immediately.

Use of Our Services

Artisan Kulture provides premium custom FF&E (Furniture, Fixtures & Equipment) solutions for the hospitality industry. Our services are intended for commercial use by qualified hospitality operators, interior designers, procurement professionals, and project managers.

You agree to use our website and services only for lawful purposes and in a manner consistent with all applicable laws and regulations. You shall not:

  • Misrepresent your identity or affiliation when requesting services
  • Use our website to distribute unsolicited commercial communications
  • Attempt to gain unauthorized access to any system or database
  • Reproduce, copy, or resell any proprietary materials without express written consent
  • Engage in any conduct that disrupts or interferes with our services

Intellectual Property

All content on this website — including product photography, design concepts, shop drawings, engineering diagrams, renderings, written copy, brand assets, and the Artisan Kulture name and logo — are the exclusive intellectual property of Artisan Kulture and are protected by applicable U.S. and international copyright, trademark, and trade secret laws.

No content may be reproduced, distributed, transmitted, modified, or used in any commercial manner without prior written authorization. Custom shop drawings and fabrication specifications produced for a client project remain the intellectual property of Artisan Kulture unless a separate written agreement transfers ownership.

Any unauthorized use of Artisan Kulture’s intellectual property may result in legal action. To request licensing permission, please contact us directly.

Project Quotations & Proposals

All quotations, proposals, and project estimates provided by Artisan Kulture are subject to the following conditions:

  • Quotes are valid for 30 days from the date of issuance unless otherwise stated in writing
  • Prices are subject to change based on material cost fluctuations, scope modifications, or factory availability
  • Proposals are preliminary in nature and do not constitute a binding contract until a formal Purchase Order or Project Agreement is signed by both parties
  • Custom or specialty material samples may require a separate approval process and timeline

Artisan Kulture reserves the right to decline any project or engagement at its discretion without obligation to provide a reason.

Payment Terms

Unless otherwise agreed upon in writing, the following standard payment terms apply to all Artisan Kulture projects:

  1. A non-refundable deposit of 50% is required to initiate production upon execution of a confirmed Purchase Order
  2. The remaining balance is due prior to shipment unless a net-terms arrangement has been approved in writing
  3. Invoices unpaid beyond their due date may accrue a late fee of 1.5% per month on the outstanding balance
  4. All payments are to be made in US Dollars via wire transfer, ACH, or approved business check

Any changes to scope after deposit has been received may result in a change order and revised invoice. Work will not proceed on change orders until written approval and applicable payment are received.

Delivery & Installation

Lead times and delivery schedules are provided in good faith based on factory and logistics availability at the time of order. Artisan Kulture shall not be held liable for delays caused by circumstances beyond our reasonable control, including factory shutdowns, port disruptions, labor strikes, natural disasters, or customs delays.

The client is responsible for ensuring the project site is ready and accessible for delivery at the agreed-upon date. Additional storage, re-delivery, or re-scheduling fees may apply if the site is unavailable upon attempted delivery.

Unless Artisan Kulture has expressly agreed in writing to provide installation services, delivery constitutes the completion of our supply obligation. Risk of loss or damage transfers to the client upon delivery.

Warranties & Product Quality

Artisan Kulture stands behind the quality of our products. All furnishings are manufactured to the specifications approved and signed off by the client. The following warranty terms apply:

  • Structural defects in manufacturing are covered for one (1) year from delivery date
  • Warranty does not cover normal wear and tear, damage from misuse, alteration, or improper care
  • Warranty claims must be submitted in writing with photographic documentation within 30 days of discovering the defect
  • Approved warranty claims will be remedied by repair, replacement, or credit at Artisan Kulture’s discretion

Custom finishes, fabrics, and COM (Customer’s Own Material) items may carry modified or limited warranty terms as specified in the project agreement.

Limitation of Liability

To the fullest extent permitted by applicable law, Artisan Kulture, its officers, employees, and partners shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from the use of our website, services, or products, even if we have been advised of the possibility of such damages.

Our total cumulative liability to any client for any claim arising out of or related to a project shall not exceed the total amount paid by the client for that specific project.

Confidentiality

In the course of a project engagement, both parties may share proprietary, confidential, or commercially sensitive information. Each party agrees to maintain the confidentiality of such information and to use it solely for the purposes of fulfilling the project obligations.

This obligation does not apply to information that is publicly available, independently developed, or required to be disclosed by law. Upon project completion or termination, either party may request the return or destruction of confidential materials.

Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising from or related to these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Hillsborough County, Florida.

Changes to These Terms

Artisan Kulture reserves the right to modify these Terms and Conditions at any time. When we make material changes, we will update the date at the top of this page. Your continued use of our website or services following any update constitutes your acceptance of the revised Terms.
